These terms cover your use of modernus.io and our Operations X-Ray. By using the site you agree to them. They are short and in plain English on purpose.
Who we are
Modernus.io is a sole proprietorship operated by Jared, at Dover Crescent, Cave Hill, St. Michael, Barbados. Contact: jared@modernus.io.
Using this site
You may use the site, the waste scorecard for your own firm. Please give accurate information, and do not misuse the site, try to break it, or submit someone else's details without their permission. The content, design and models on this site belong to Modernus.io.
Scorecard figures are estimates
The figures the scorecard produces are modelled estimates based on your answers and our assumptions. They are not measurements of your firm. They are not legal, financial, accounting or other professional advice, and you should not rely on them as such. Decisions you make based on them are your own.
The Operations X-Ray
Price and credit
The Operations X-Ray costs USD 1,500. If you start a build with us within 90 days of receiving your plan, the full USD 1,500 is credited against the price of that build.
The guarantee
If the X-Ray does not find at least USD 100,000 in recoverable waste, we refund the fee in full.
The waste is measured on your firm's own numbers, at the rates we agree with you in writing at the scoping call. You keep the findings either way.
Confidentiality
Confidentiality is covered by a separate written confidentiality agreement, which we both sign before any work starts. If that agreement and these terms conflict, the agreement wins. We never collect your clients' data; see the Operations X-Ray page and our privacy policy.
Builds
Any build we do for you will be set out in its own written proposal or agreement. We work hard for results, but we cannot guarantee specific outcomes, savings or revenue from a build, because they depend on how the firm uses what we build and on things outside our control.
Limitation of liability
To the extent the law allows, our total liability to you for anything arising from the site, the scorecard or our services is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits or lost opportunities. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of Barbados, and the courts of Barbados have jurisdiction over any dispute.
Changes to these terms
We may update these terms. The date at the top shows the latest version. Changes do not affect a paid engagement already under way, which stays on the terms that applied when it was agreed.
